O crime de abuso de poder

Abstract

O crime de Abuso de Poder está p. e p. no art. 382º do CP-Código Penal português: “O funcionário que, fora dos casos previstos nos artigos anteriores, abusar de poderes ou violar deveres inerentes às suas funções, com intenção de obter, para si ou para terceiro, benefício ilegítimo ou causar prejuízo a outra pessoa, é punido com pena de prisão até 3 anos ou com pena de multa, se pena mais grave lhe não couber por força de outra disposição legal”, Secção III, a qual tem por título, “Do abuso de autoridade”. § The crime of Abuse of Power is p. and p. in art. 382º of the CP-Portuguese Penal Code: "An official who, other than in the cases provided for in the previous articles, abuses of powers or violates duties inherent to his functions, with the intention of obtaining for himself or for third parties an illegitimate benefit or causing harm to another person, shall be punished with imprisonment for up to 3 years or with a fine, if a more severe penalty does not apply to him under another legal provision, "Section III, entitled" Abuse of authority ".
